1. License Authorization

Upon successful purchase, NightMiner grants you a limited, non-exclusive, and revocable license to use the software for the duration of your subscription term.

• You may not redistribute or resell your license key.
• You may not attempt to reverse-engineer or modify the software.
• The license is tied to your hardware and cannot be shared.

2. Service Evolution

We reserve the right to modify or update the software at any time to ensure compatibility with third-party platforms or to introduce new features. Service availability is subject to maintenance periods and external platform updates.

If a Clash of Clans (or emulator) change breaks core features for a meaningful period while we prepare a patch, we may, at our sole discretion, extend active licenses as goodwill compensation. Any such extension is a courtesy, not an entitlement, and does not create a refund right or a duty to compensate for every interruption or minor regression.

3. Software "As Is" & Accuracy

NightMiner is provided as is and as available, without warranties of any kind, including fitness for a particular purpose, accuracy, reliability, or uninterrupted operation.

The software automates gameplay by reading the screen (computer vision / templates / colors) and simulating taps and swipes. It is not an exact game API. Detections and actions may be incorrect, including but not limited to:

• Wrong numbers, counts, or resource readings.
• Missed taps, extra taps, or the wrong nearby button.
• Unexpected upgrades, spends, or failed runs.

You accept the in-game consequences of such behavior. Third-party game updates, emulator settings, resolution, scaling, performance, and your hardware are outside our control and may affect results.

4. Liability & Risk Factors

Critical Disclosure: The use of automation tools violates most third-party gaming service agreements. By using NightMiner, you acknowledge that:

• Your account may be subject to penalties, including permanent suspension.
• NightMiner is not affiliated with Supercell, Clash of Clans, or any game developers or publishers.
• We are not responsible for any loss of digital assets, account access, resources, trophies, time, or progress.
• We are not responsible for inaccurate detections, misfires, or unexpected in-game actions performed by the software.

You use this tool entirely at your own discretion and risk.

To the maximum extent permitted by law, our aggregate liability arising out of or related to your purchase or use of NightMiner is limited to the amount you paid for the license period giving rise to the claim.

5. No-Refund Policy

Due to the immediate delivery of digital goods (license keys), all transactions are final. Once a key has been transmitted to your email, the sale is irreversible.

No refunds will be granted under any circumstances, including but not limited to:

• Account bans or suspensions.
• Software incompatibility with your specific hardware.
• Changes in third-party platform policies.
• Unused subscription time.
• Inaccurate detections, misfires, or unexpected in-game actions.
• Temporary downtime or regressions after a game or emulator update.

Opening a chargeback or payment dispute with your bank or card issuer will result in immediate revocation of the associated license and termination of access, without prejudice to any other remedies available to us.

6. Agreement Termination

Any violation of these terms will lead to immediate revocation of your license without notice and without the right to any compensation or refund.
